Who Needs to File PCORI Fee?

1. Self-Insured Health Plans

Plan sponsors (generally employers) that maintain applicable self-insured health plans are responsible for reporting and paying the PCORI fee using Form 720. The fee is calculated based on the average number of covered lives during the plan year.

3. Issuers of Specified Health Insurance Policies

Insurance issuers that provide specified health insurance policies are responsible for filing Form 720 and paying the PCORI fee. The fee is based on the average number of covered lives under the policy.

2. Health Reimbursement Arrangements (HRAs)

An HRA is generally treated as an applicable self-insured health plan and is subject to the PCORI fee unless it qualifies as an excepted benefit arrangement. The plan sponsor (employer) is responsible for reporting and paying the fee.

  • QSEHRA (Qualified Small Employer HRA) - A QSEHRA is an HRA arrangement. It is not automatically exempt from PCORI fees. The applicability depends on whether the arrangement meets an exception, such as being treated as an excepted benefit.
  • ICHRA (Individual Coverage HRA) - An ICHRA is generally subject to the PCORI fee because it is an applicable self-insured health plan. The employer sponsoring the ICHRA is responsible for filing Form 720 and paying the fee.
  • GCHRA (Group Coverage HRA / Integrated HRA) - A GCHRA is generally subject to the PCORI fee. However, if the HRA and another applicable self-insured health plan have the same plan sponsor and the same plan year , special rules may allow them to be treated as one plan for PCORI fee calculation purposes.
